
COWLEY COUNTY—Law enforcement are investigating a suspect on multiple allegations after a domesstic incident in Cowley County.
Just before 3:30a.m. Monday, a 61-year-old woman fled to a neighbor's home seeking help after allegedly being strangled by her son, Kody Wayne Nuss, 42, of Arkansas City, according to a statement from Arkansas City Police. During the assault, the victim's glasses were broken, and her cellphone, medication, and vehicle were taken. Nuss fled the area before officers arrived.
At 6:32 a.m. that same day, officers responded to a report of the stolen vehicle being driven erratically and striking a parked vehicle. Officers located Nuss as he exited the vehicle and advised him he was under arrest.
Nuss refused officers' commands and became verbally combative. As officers escorted him to a patrol vehicle, Nuss, while handcuffed behind his back, attempted to grab an officer's holstered firearm. Officers immediately prevented him from gaining control of the weapon, and force was used to safely take him into custody. A search following Nuss' arrest recovered the victim's cellphone and medication.
As part of the investigation, officers developed probable cause to investigate Nuss for driving under the influence. A search warrant was obtained for a blood sample. Because Nuss continued to resist, officers used the force necessary to safely execute the warrant and allow Arkansas City Fire/EMS personnel to obtain the sample.
Nuss was transported to the Cowley County Jail, where he remains in custody on a bond of $52,000 on requested charges of Aggravated Domestic Battery, Aggravated Robbery, Aggravated Assault on a Law Enforcement Officer, Interference with Law Enforcement, Theft, Criminal Damage to Property, Possession of a Depressant, and Driving Under the Influence. Additional traffic-related charges are expected through the Cowley County Attorney's Office.
